Does anyone know the batf rules for a pistol lower. I get conflicting ideal's by reading up on it. Specificly is it legal to put a standard 16" upper on a pistol lower with an adjustable rear stock. I hear you can use the loger upper but you cant use a verticle forestock or a buttststock of any kind. If it is a pistol only lower. Is it tru that a buttstock on a pistol lower turns it in to a sbr in the eye's of the batf? Even if it is a legal 16" plus barrel. Basicly I want to get a pistol lower use a pistol upper on it. Or use my 20" hb target upper with a buttstock and a verticle forestock with a built in bi-pod. Would this be a legal setup in all of its form's?

The lower must be registered as a pistol lower from Manufacturer, 4473 and the dealers book. Â* Plan on paying 2-3X the price of a rifle lower. Â*If it is registered as a pistol, and you put a butt stock on it you now have made SBR and you have broke federal law. Â*Also if you have a butt stock for an AR and not on the weapon, you can get busted for attempt at a SBR. You CANNOT switch uppers legally from 16"> with butt stock to non buttstock, pistol barrel!

I know about it having to be a pistol lower from the manuf. I was thinking that if you use a pistol lower but have a full length upper if it has a buttstock it is not a sbr as it has a full upper. Just wondering. So if you have a pistol and a full length ar you are ok as long as you have both of them complete? Thanks Pb

As long as the upper barrel, BARREL is over 16", flash hiders do not count unless they are permently welded to the barrel for length. With 16"> barrel length you can add butt stock, but DO NOT get caught with a pistol barrel and a butt stock (even off the weapon and in the same house), ATF consters this "intent" to make a SBR! I've been an FFL for over 14 years, and it's put out just about every year by ATF about SBR Pistol AR's.

Well I guess I dont want to do it that way then. I just thought it would be easier to have one lower and two uppers. I guess I will just get a pistol and call it good I already have a 20 hb dpms left hand upper and a lwc lower. Thanks for the help P.B. John C
